Terms of Service

Welcome to Sofa Air ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at sofaair.com (the "Site") and any purchases you make through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Site or place an order. By using the Site, you represent and warrant that you meet these requirements.

2. Account Registration

You may create an account to access features such as order history, saved addresses, wishlists, and product reviews. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Products & Configurator

We sell air-compressed cloud sofas and modular sofa configurations. Product descriptions, images, and specifications are provided for informational purposes and may vary slightly from the actual product due to photography, display settings, or minor manufacturing differences. We reserve the right to modify product offerings, pricing, and availability at any time without prior notice.

Our Sofa Configurator allows you to build custom modular sofa layouts by selecting piece types (left armrest, right armrest, middle seat, ottoman) and colors. Configured sofas are subject to stock availability of individual pieces at the time of checkout.

4. Pricing & Payment

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We verify product prices server-side before processing any payment. If a pricing error is discovered, we reserve the right to cancel the order and issue a full refund.

Payments are processed securely through Stripe, Inc. We do not store your credit card information on our servers. By submitting your payment, you authorize us to charge the total order amount, including applicable shipping fees, to your selected payment method. We may accept credit/debit cards, Apple Pay, Google Pay, and other payment methods supported by Stripe.

5. Orders & Fulfillment

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including stock availability, suspected fraud, or pricing errors. You will receive an order confirmation upon successful payment; this confirmation does not guarantee shipment until the order has been processed and dispatched.

6. Shipping & Delivery

We currently deliver exclusively to Oahu, Hawaii. Orders shipped to addresses outside of Oahu will not be accepted. We offer the following delivery options:

  • Free Standard Delivery — Available on all orders delivered to Oahu.
  • Express Delivery ($49) — 6-hour delivery window for eligible orders.

Delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, weather, or circumstances beyond our control.

7. Return & Refund Policy

All sales are final. Due to the nature of our air-compressed sofas, we cannot accept returns or offer refunds for change-of-mind purchases. Once the vacuum-sealed packaging is opened and the sofa begins expanding, it cannot be repackaged or resold as new.

  • Cancellations: Orders may be cancelled within 30 minutes of placement, provided the order has not entered processing.
  • Damaged or Defective Items: If you receive a damaged or defective product, you must report it within 48 hours of delivery by contacting us with photos. We will assess the claim and, at our discretion, arrange a replacement or issue a refund.

8. Discount Codes & Promotions

Discount codes and promotional offers are subject to specific terms and expiration dates. They cannot be combined unless explicitly stated, have no cash value, and may be revoked or modified at any time. We reserve the right to void orders that improperly use discount codes.

9. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, product photos, configurator images, blog posts, and software — is the property of Sofa Air or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

10. User Content

By submitting content to the Site (such as product reviews or contact form messages), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute such content in connection with our business. You represent that you own the rights to any content you submit and that it does not violate any third-party rights or applicable laws.

11. Privacy & Data Collection

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to our data practices as described therein.

We use cookieless analytics to understand how visitors interact with our Site. This method does not store cookies on your device but may process anonymized session data derived from your IP address and browser information.

12. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Interfere with or disrupt the Site's operation, servers, or networks.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or systems.
  • Use automated tools (bots, scrapers, crawlers) to access or collect data from the Site without our written permission.
  • Submit false, misleading, or fraudulent orders or account information.
  • Post defamatory, obscene, or harmful content in reviews or other user-submitted areas.

13. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the fullest extent permitted by law, Sofa Air and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or purchase of products, including but not limited to loss of profits, data, or goodwill. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Sofa Air, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to the personal jurisdiction of such courts.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
